Terms and conditions

In short: You get a designed collector card with a profile page – as a yearly profile (12 months from the conclusion of the contract, cancellable for the first time at the end of the 12 months, thereafter with one month's notice; the fee is charged annually in advance, and you get unused full months back) or as “Profile page – permanent access” with a one-time payment. You are responsible for your content, I am responsible for technology and operation. You can withdraw and cancel online at any time. The text below is binding.

§ 1 Scope, provider, target group

(1) These terms and conditions apply to all contracts for digital collector cards and profile pages (“KinkID”) that you conclude with me via kinkid.link or by e-mail. The provider and your contractual partner is:

(2) My offer is aimed exclusively at adults (aged 18 or over). In justified cases of doubt, I may request proof of age and refuse the contract or – if it turns out that you are a minor – terminate it for cause and take your page offline immediately.

(3) A “consumer” is anyone who concludes the contract predominantly for private purposes (§ 13 BGB, German Civil Code), an “entrepreneur” is anyone acting in a commercial or self-employed professional capacity (§ 14 BGB). Deviating terms of yours only apply if I expressly agree to them.

§ 2 Services

(1) Based on your information, I design a digital collector card with a profile page (a digital product within the meaning of §§ 327 et seq. BGB) and make it available on the internet for the duration of the contract – depending on the package under an address on kinkid.link and, if you wish, additionally under your own domain. Which components are included follows from the package description on the offer page or from my offer at the time the contract is concluded.

(2) Prices: “Profile page – yearly” €12 per year, “Profile page – permanent access” €48 one-time, printed NFC card €20 (§ 2a). There is no setup fee (launch offer). An own domain is available as an add-on to both packages. The domain service (para. 8) costs €8 per year for a new .de domain in addition to the chosen package; for a new domain with another ending, I will send you an offer by e-mail. I connect a domain you already own at no extra charge.

(3) For the design, I send you a draft – no later than 14 days after you have sent me the photo and information in full; if I only start after the withdrawal period has expired (§ 12), this period runs from its end. After your approval, I activate your page within 7 days at the latest. Up to two rounds of corrections to the draft are included. After that, for the yearly profile, up to 3 change requests per contract year are included (e.g. new photos, texts, links, colours); unused changes lapse at the end of the contract year. I carry out further changes after prior agreement for a fee that we agree in advance. For the package “Profile page – permanent access”, up to 3 change requests are included in the first year from activation and up to 1 change request per year from the second year; unused changes lapse at the end of the respective year. Each further change costs €5, which I will tell you in advance. Remedying defects (§ 10) is never a change request.

(4) Package “Profile page – permanent access”: With the one-time payment, I operate your page indefinitely, without further costs; the setup is included in the price. Details on term and end are set out in § 6(5).

(5) Address: I assign a desired name (e.g. kinkid.link/yourname) as long as it is free and does not infringe the rights of third parties (name, trademark or personality rights); there is no entitlement to a particular name. An address with a “private random code” cannot be guessed and is not listed in search engines – but anyone who knows the link can see the page. I never assign a chip link or random code to another person, even after the contract ends, so that NFC cards or QR codes do not lead to other people's pages.

(6) Your card is only included in the public card deck if you wish; you can have it removed again at any time. Visitors who scan your chip or QR code can put cards in the card deck into their personal card album on kinkid.link. The album only stores a random identifier of your card, not your name, your contact details or your chip code; who has collected your card cannot be seen by you or by me. If you take your card out of the card deck or the contract ends, I also remove it from all albums.

(7) Events: If you connect a calendar (e.g. iCloud or Google) to your page, its events are displayed automatically and without prior review by me and are updated regularly. You decide which events are in this calendar.

(8) Domains: If you use a domain you already own for your page, it remains your responsibility; you ensure that it is paid for and set up as agreed (usually you change the name servers according to my instructions). You confirm that the domain belongs to you or that you are allowed to use it. If the connection fails for reasons relating to your provider or your domain, your page remains available under kinkid.link; the price of your package does not change as a result. If you choose the domain service, I register the domain in your name as the holder with a registrar of my choice and set it up. The domain service is charged annually in advance (payment method under § 4(3); price see para. 2). You can cancel the domain service for the first time at the end of the first 12 months (cancellation at least one month before), thereafter at any time with one month's notice; for full months already paid after the end of the contract, I refund you one twelfth of the annual fee of the domain service per month in accordance with § 6(1). I renew the domain automatically as long as the domain service is running. If it ends (through cancellation, with the end of the contract or due to late payment after a deadline under § 4(4)), I send you the auth code in good time before the domain expires so that you can transfer it to another provider; I never let a domain expire without giving you this opportunity. Whether a desired domain is free is decided by the registry; I cannot guarantee this. If your desired domain is not (or no longer) free at the time of registration, I will let you know by e-mail, and you can choose another free domain. If you do not want this, the domain service ends and I refund you the amount already paid for it in full; the rest of your contract remains unaffected. I only register the domain after the withdrawal period has expired, unless you expressly request that I start earlier – in that case, the costs of the domain already registered are part of the service provided, which you pay for proportionally if you withdraw (see instructions on withdrawal). The terms of the respective registry (e.g. DENIC for .de) also apply to the domain.

(9) I may use service providers to provide the services (in particular hosting, domain registration, payment processing); which ones are listed in the privacy policy.

(10) You may use and share images of your card (e.g. screenshots or the preview images I send you) for your own non-commercial purposes without time limit – for example as a profile picture or on social networks, even after the contract ends. The design templates, effects and the software behind them remain mine; you may not copy them or use them for other cards.

(11) In addition, you can order a printed NFC card; § 2a applies to it in addition. I do not sell card holders.

§ 2a Printed NFC card

(1) The printed NFC card is a card in credit card format with the design of your digital card and an NFC chip that opens your chip link when held to a phone. It costs €20 per card; shipping by letter within Germany is included; for delivery to another EU country I charge €4.95 shipping in addition. I do not ship to addresses outside the EU. The card is produced by a print shop on my behalf. It is a printed still image: effects (e.g. foil shine and light reflections), animations, the 3D movement and the motif that pops out of the frame of the digital card cannot be reproduced in print and are not part of the printed card. It resembles the digital card in motif, name and design but is not identical to it.

(2) Only cards with a printed NFC card receive a card number and can be collected by others in the card album. A profile page without a printed card is possible; it then has no card number and cannot be collected.

(3) Before printing, I send you the front and back as an image for approval. Printing only takes place after your express approval (e.g. by e-mail). Errors already contained in the approved design (e.g. typos in your name) are not a defect; nor are small colour differences between screen and print.

(4) The card is made to your specifications and clearly tailored to you (name, design, your personal chip link). There is therefore no right of withdrawal for it (§ 312g(2) no. 1 BGB). Your right of withdrawal for the profile page and your statutory rights in the event of defects of the card remain unaffected.

(5) Delivery time: dispatched no later than 14 days after you approve the print design, often sooner; then 1–3 days in Germany, usually 3–10 days to other EU countries. I bear the risk of loss in transit: if the card does not arrive, I will send you a new one free of charge as soon as you let me know.

(6) If the card is defective (e.g. printing errors that were not in the approved design, or a chip that does not work), the statutory rights for defects apply. As a rule, you get a new card free of charge; you only have to return the defective one if I ask you to and bear the costs.

(7) I do not sell card holders. The card fits standard holders in credit card format.

(8) You can reorder additional or replacement cards (e.g. after loss following receipt) at any time at the current price; a new chip link is not necessary for this.

§ 3 Conclusion of the contract and contract text

(1) The presentation of the packages on the website is not a binding offer but an invitation to submit an enquiry or order.

(2) Draft from the designer: Enquiries and orders via the form require a sent draft from the designer; it is the basis for the design of your card. You can change it until the enquiry or order; after that, changes go through me (§ 9). I delete drafts without an enquiry or order 14 days after the last change; there is no right to have them kept.

(3) Enquiry: With a non-binding enquiry you send me your wishes. I reply by e-mail with an offer, these terms and conditions and the instructions on withdrawal. The contract is concluded when you accept this offer (e.g. by e-mail).

(4) Order: You choose a package, enter your details and confirm the terms and conditions. Before submitting, you see a summary with package and price and can check and change all details in the form (you correct input errors directly in the fields). By clicking the button “Order with obligation to pay” you submit a binding offer and are forwarded to Stripe for payment. The contract is concluded as soon as the payment has been completed successfully; you receive a confirmation of this by e-mail.

(5) Contracts can be concluded in German or in English; the contract language is the language in which you place your order or accept my offer. I send you the contract text (your details, package, price, these terms and conditions and the instructions on withdrawal) by e-mail after the contract is concluded; I also store it myself. You can access, save and print the current terms and conditions on this page at any time, in English and in German (Allgemeine Geschäftsbedingungen).

§ 4 Prices, payment, late payment

(1) The prices at the time of the order or from my offer apply. All prices are final prices. No VAT is charged (small business exemption under § 19 of the German VAT Act, UStG).

(2) One-time amounts (the price of the package “Profile page – permanent access” and the printed NFC card) and the first annual fee (including that of the domain service) are due when the contract is concluded. Each further annual fee is due in advance at the beginning of the next contract year. In good time before each renewal payment – at least two weeks before – I remind you by e-mail of the amount, date and your option to cancel.

(3) Payment is made via the payment service Stripe using the payment methods offered there. Subsequent payments are collected via the same payment method; you can change it at any time. You receive an invoice by e-mail.

(4) If you are late with a payment that is due, I will remind you by e-mail and set you a deadline of at least 14 days. If you still do not pay, I may take your page offline temporarily until payment is received; your content is retained. The right to terminate for cause (§ 6(3)) remains unaffected.

§ 5 Price changes

(1) The price does not change during the first 12 months. For the package “Profile page – permanent access” (§ 6(5)) there are no price changes; it is paid in full with the one-time payment.

(2) After that, I may propose an adjustment of the annual fee for the future if my costs for providing the service (in particular hosting, domains, payment processing) have changed after the contract was concluded. I send you the proposal in text form (e.g. by e-mail) at least six weeks before it is to take effect. It only takes effect if you expressly agree to it. If you do not agree, the contract continues at the previous price; I can then terminate it with the normal notice period of one month. Periods already paid for are never affected by a price change.

§ 6 Term and cancellation

(1) For the yearly profile, the contract initially runs for 12 months from the conclusion of the contract. You can cancel for the first time at the end of the 12 months; the cancellation must then reach me at least one month before. After the first 12 months, the contract is extended for an indefinite period and can then be cancelled by either party at any time with one month's notice. The annual fee (€12) continues to be charged annually in advance (§ 4(2)). If you cancel after a renewal – or if the contract otherwise ends before the end of a year already paid for –, I refund you €1 for each full month between the end of the contract and the end of the year already paid for – at the latest 14 days after the end of the contract via the payment method you used.

(2) You can cancel in text form (e.g. by e-mail), by letter or via the button “Cancel contracts here”. I confirm every cancellation without undue delay by e-mail, stating the date on which the contract ends.

(3) The right of both parties to terminate for good cause remains unaffected. Good cause exists for me in particular in the case of serious violations of § 7(2), or repeated violations despite a warning, in the case of minority, or if you are in arrears with more than one annual fee despite a deadline under § 4(4).

(4) After the contract ends, I take your page and your card offline. Your chip link then only shows a neutral note that the page is no longer active. I delete your content within 30 days, backups after 90 days at the latest, unless there are statutory retention obligations (e.g. for invoices). On request, I send you your photos and texts back beforehand (§ 327p(3) BGB). For the domain service, I transfer the domain to another provider on request (handover of the auth code).

(5) Package “Profile page – permanent access”: With the one-time payment, I operate your page from activation indefinitely and without further costs. I can only terminate this contract with notice in one case: if I have closed the shop (no more new orders) – and then at the earliest at the end of 5 years after the closure and with a notice period of at least 6 months by e-mail. Until then, I will continue to operate your page in any case. If operation ends for reasons relating to me (death, permanent incapacity for work, insolvency) before 5 years have passed since your page was activated, you will be refunded €9.60 (the price divided by 5) for each full year up to then that you can no longer use – in the event of death by my heirs; after 5 years, the package is fully paid off. Before the shutdown, you get your content (photos, texts, links and information on your page) back in a common format (data export). You can cancel at any time without notice; there is then no refund. Termination for good cause (para. 3) remains unaffected.

§ 7 Your content

(1) You provide photos, texts, links, information and events from a connected calendar; you are responsible for them. You assure that you are at least 18 years old, that you have the necessary rights to your content (e.g. for a photo also the consent of the photographer) and that all persons shown are adults and have explicitly consented to their image being processed for your card and published – including in a kink context. On request, you prove their consent and pass on to them the section “Other people in photos” of the privacy policy. This also applies to everything you upload in the designer.

(2) The following in particular are not permitted:

(3) You grant me the simple right, limited to the term of the contract, to edit your content (e.g. crop, cut out, reduce in size, remove camera data such as the location) and to make it publicly accessible within the scope of this contract.

(4) If you culpably infringe the rights of third parties, you indemnify me against the resulting claims, including reasonable costs of legal defence.

(5) Please keep your own copies of your photos and texts; I am not a storage or archive service.

(6) Linked profiles and pages must not show freely accessible pornographic content. If you link a profile on a platform that permits such content, it must be protected there against freely accessible viewing – on X, for example, by marking your profile or media as sensitive. Links are just links; content from other platforms is not embedded on your page.

(7) I may refuse, not publish, take offline or remove content and links that violate these rules. How I proceed and how you can object is set out in § 8.

(8) The card deck and the card album are only visible after an age check (“I am 18 or older”); profile pages and cards have no check of their own. The rules in para. 2 apply regardless.

§ 8 Handling of reported and inadmissible content

(1) Anyone can report content they consider unlawful via “Report content”. I examine reports myself, promptly and carefully; I do not use automated moderation tools.

(2) If content violates § 7(2) or the law, I may – depending on the severity and always proportionately – remove the individual content, disconnect your calendar, take your page offline temporarily or, in the case of serious or repeated violations, terminate the contract for cause. In the event of acute danger (e.g. for minors), I act immediately.

(3) I inform you of every measure by e-mail with a statement of reasons (which content, which measure, on what basis) and give you the opportunity to comment. You can object to the decision by e-mail; I will then review it again. Your right to go to court remains unaffected.

§ 9 Provision, updates and changes

(1) I endeavour to keep your page available as continuously as possible. Short interruptions due to maintenance, disruptions at service providers (e.g. hosting, domain registration) or force majeure cannot always be avoided. Your statutory rights in the event of a significant impairment (§ 10) remain unaffected.

(2) During the term of the contract, I provide the updates necessary for your page to work and remain secure (§ 327f BGB).

(3) Functionality and compatibility: Your page is a web page and runs without an app and without an account in the current versions of common browsers (e.g. Safari, Chrome, Firefox, Edge) on phone, tablet and computer. Phones with NFC (current iPhones and most Android phones) read the chip of the printed card; alternatively, the printed QR code (if on the back) leads to the page. I do not use technical protection measures (e.g. copy protection).

(4) In addition, I may further develop the technology and the design templates (e.g. new effects, adaptations to new browsers, change of a service provider) if there is a valid reason for this and you do not incur additional costs (§ 327r BGB). If such a change impairs your access or use more than insignificantly, I will inform you clearly and comprehensibly by e-mail in advance; you can then terminate the contract free of charge within 30 days of the information or the change.

§ 10 Warranty

(1) The statutory rights for defects apply, for consumers in particular the provisions on digital products (§§ 327d et seq. BGB). Please report a defect to me by e-mail; I will remedy it free of charge within a reasonable period.

(2) Content you have supplied is not a defect, nor are differences in display caused by very old or unusual browsers and devices, provided that your page works properly in current versions of common browsers.

§ 11 Liability

(1) I am liable without limitation for intent and gross negligence, for injury to life, body or health, for fraudulently concealed defects, under a guarantee and under the German Product Liability Act.

(2) In the case of slight negligence, I am only liable for breach of an essential contractual obligation (an obligation whose fulfilment makes the proper performance of the contract possible in the first place and on whose compliance you may rely), and limited to the foreseeable damage typical for the contract.

(3) I am not responsible for content you provide or for events from your calendar as long as I have no knowledge of their illegality (Art. 6 DSA).

§ 12 Right of withdrawal

As a consumer, you have a statutory right of withdrawal. The details are set out in the instructions on withdrawal. You can withdraw directly online via “Withdraw from contract here”. There is no right of withdrawal for the printed NFC card because it is made to your specifications (§ 2a(4), § 312g(2) no. 1 BGB).

§ 13 Data protection

How I handle your data is set out in the privacy policy. Because KinkID is a service for the kink and pup scene, your profile page alone may allow conclusions about your sex life or sexual orientation (Art. 9 GDPR). I therefore only design and publish it with your explicit consent. If you withdraw it, I take your page offline and the contract ends. I refund full months already paid for that you can no longer use as a result within 14 days (for the yearly profile €1 per month as in § 6(1)); for the package “Profile page – permanent access”, I refund you €9.60 (the price divided by 5) for each full year up to the end of 5 years after activation that you can no longer use. I only show a list of your kinks and sexual preferences with an additional, separate consent; it is not a prerequisite for the contract and can be withdrawn at any time.

§ 14 Changes to these terms and conditions

For existing contracts, amended terms and conditions only apply if you expressly agree to them. Without your consent, your contract continues under the previous terms.

§ 15 Final provisions

(1) The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, this choice of law only applies insofar as it does not deprive you of the protection of mandatory provisions of the law of the country in which you have your habitual residence.

(2) If you are a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction is my place of residence.

(3) I am neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board (§ 36 VSBG).

(4) Should any provision of these terms and conditions be invalid, the remaining provisions remain valid; the statutory provision takes the place of the invalid provision.
